Services

MomentumWeb ("we", "us", "our") provides website design, development, hosting, and maintenance services. By purchasing any plan or service through our website you agree to be bound by these terms.

Payment

All payments are processed securely through Stripe. Prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Subscription charges (hosting, maintenance) recur monthly until cancelled. One-time website build fees are charged at the time of purchase.

Refunds

Website build fees are partially refundable up to 80% if you are not satisfied with the final result. Refund requests must be made within 7 days of project delivery. Hosting and maintenance subscription fees are non-refundable for the current billing period but you may cancel at any time to prevent future charges.

Hosting

We provide managed hosting as part of our plans. We aim for high uptime but do not guarantee 100% availability. We are not liable for downtime caused by third-party infrastructure providers, force majeure events, or scheduled maintenance. You may request transfer of your hosting and domain to your own provider at any time.

Revisions

Each website plan includes a specified number of revision rounds as described on the plan page. Additional revisions beyond the included rounds may incur extra charges, which will be quoted and agreed upon before work begins.

Client responsibilities

You are responsible for providing all content (text, images, logos, branding assets) required for your website in a timely manner. You warrant that any content you provide does not infringe the intellectual property rights of any third party and is lawful. Delays in providing content may delay project delivery.

Intellectual property & ownership

Upon full payment, you own the final website content and custom design created for your project. We retain the right to use third-party tools, libraries, and frameworks under their respective licences. We may showcase your completed project in our portfolio unless you opt out in writing.

Termination

Either party may terminate the ongoing relationship (hosting, maintenance) at any time by providing written notice. Upon termination, we will assist with transferring your website files and domain. Access to our hosting infrastructure will cease at the end of the current billing period.

Limitation of liability

To the maximum extent permitted by law, MomentumWeb's total liability for any claim arising from or related to our services is limited to the total amount you have paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunity.

Privacy

We collect and process personal information (name, email, payment details) solely for the purpose of delivering our services and communicating with you. We do not sell your data to third parties. Payment information is handled securely by Stripe and is never stored on our servers.

Governing law

These terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
